Terms and Conditions

These terms and conditions (the “Terms“) apply to the Club IR Scheme and your use of an active Club IR account (“Club IR Membership“) via either the Club IR App or if a Diamond Member your physical Club IR Card. These Terms govern your participation in the Club IR Scheme from the date you download the Club IR App throughout your Club IR Membership and your use of any of the Rewards, Events and Experiences.

 Terms and Conditions

  1. The promoter of the Club IR Scheme is – Individual Restaurants (IRC) Limited, First Floor Northern Assurance Buildings, 9-21 Princess Street, Manchester M2 4DN (“we“, “us, “our” or “IR“) under which Club IR Members may obtain access to Rewards, Events and Experiences when they visit any of “Piccolino”, “Riva Blu”, “The Restaurant Bar and Grill”, “Bank Restaurant & Bar”, “Opera Grill” or “Piccolo by Piccolino” owned by Individual Restaurants (the “Participating Restaurants“) using their Club IR Membership mobile application or, if a Diamond Member, your physical Club IR Card at the time of the visit.
  2. The Club IR Scheme is available to persons aged 18 and over who download the Club IR App from the Apple App Store or the Google Play Store and create an account. You will need a compatible smartphone to download the Club IR App to activate your Club IR Membership and participate in the Club IR Scheme. Only individual guests are eligible for Club IR Membership and each individual can only register for one Club IR Membership. In the case of a guest holding multiple memberships, all of those memberships may be deleted along with access to Rewards, Events and Experiences.
  3. The Club IR Membership will remain active as long as the Club IR Member continues to use the membership at least once every 24 months. Following a period of inactivity of 24 months or more, member accounts will be deleted.
  4. Club IR Memberships which are not active are not entitled to any Rewards, access to Events or Experiences or other benefits of membership.
  5. Access to Rewards, Events and Experiences for Club IR Members and guests aged eighteen and over only.
  6. A holder of an active Club IR Membership is hereafter referred to as a “Club IR Member“.
  7. It is strictly prohibited for a Club IR Membership to be used by anybody other than the Club IR Member. In the case of misuse all memberships of persons involved may be deleted along with any entitlement to Rewards, Events and Experiences and may also include a ban from visiting any restaurant operated by Individual Restaurants.
  8. A Club IR Membership is personal to the Club IR Member and access to Rewards, Events and Experiences may not be transferred to or from one Club IR Membership to another, save where a Club IR Member is explicitly permitted to bring a guest(s).
  9. A Club IR Membership is not a store card or a credit card, it is the way in which IR shows appreciation of a Club IR Member’s loyalty by rewarding them every time they visit a Participating Restaurant. As such, Rewards, Events and Experiences have no monetary value and cannot be exchanged for cash or credit.
  10. We have the right to withdraw, cancel or change the terms of the Club IR Scheme and/or Club IR App at any time.
  11. There is no charge to become or retain membership of the Club IR Scheme.
  12. We aim to ensure that the Club IR App is available but due to the nature of mobile and online services, we cannot guarantee this at any time.
  13. The Club IR App is free to download but you are responsible for any connection or data charges arising from your download, installation or use of the Club IR App.
  14. By using the Club IR App, you agree that IR may use your information including your geographical location, to (i) better understand your dining behaviours; and (ii) to provide you with Rewards, Events and Experiences (which may include sharing your information with third parties for the purpose of providing such Rewards, Events and Experiences) under the Club IR Scheme (who will be the only recipients of your information) irrespective of your Privacy preferences selected at sign up. IR will collect information about the App’s functionality that you access and use. This allows us to identify those areas of the App that are of interest to our guests so that we can refine and continuously improve the Club IR App. We also store data such as login details (Club IR number, surname, postcode and your date of birth), mobile phone number, email address, current balance and spend information and details of your current rewards so that you can view your offers and points balance when you don’t have a network connection, and also to prevent you having to re-enter your login details every time you launch the App. We also collect a unique identifier for your mobile device so that we can link your device to your Club IR account for security purposes.
  15. To the extent there is any conflict between the general Club IR Scheme Terms and Conditions and the terms and conditions of an individual reward, the terms of the individual reward will prevail.

Membership Tiers

  1. There are multiple membership tiers of the Club IR Scheme. Club IR Members can qualify for different tiers depending upon a Club IR Member’s annual spend on food and drink in a Participating Restaurant (the “Spend“) which governs access to Rewards, Events and Experiences.
  2. The Spend of each Club IR Membership will be assessed as follows:
    1. new members, on the anniversary of joining Club IR; or
    2. for existing members, on the anniversary of moving up or down a membership tier based on their Spend.
  3. Spend:
    1. is only calculated on purchases of food and drink to be consumed within Participating Restaurants. The amount credited shall be equal to the item total on the bill; and
    2. excludes service charges, discretionary tips, gift card purchases and any other non-food or drink items.
  4. Club Membership Tier applies to guests who join Club IR and have an annual spend of up to £749.
  5. Black Membership Tier applies to those Club IR Members who have an annual Spend of between £750 and £2499.
  6. Diamond Membership Tier applies to those Club IR Members who have an annual Spend of £2500 and over.
  7. If a Club IR Member fails to achieve the required level of Spend in the relevant 12-month period, their Membership will be downgraded accordingly.
  8. Black Membership Tier gives access to all Club Memberships Tier Rewards, Events and Experiences.
  9. Diamond Membership Tier gives access to all Club Membership Tier and Black Membership Tier Rewards, Events and Experiences.
  10. Annual spend for those customers who transfer from IR’s previous loyalty scheme (Club Individual) to the new Club IR scheme, is based on their spend between 16th October 2022 and 15th October 2023.
  11. In order for this Spend to apply, the Club IR Member must use the same email address to register for the Club IR Scheme as previously used for the Club Individual loyalty scheme.
  12. Where customers transfer from the Club Individual scheme, the new earning period will commence on 4 January 2024, and run for 12 months from this date.

Rewards, Events and Experiences

  1. Club IR Members must be present to earn, spend and redeem Rewards or access to Events and Experiences. To earn, spend or redeem Rewards the Club IR App must be presented at the time of requesting the bill.
  2. A Reward cannot be used in conjunction with any other offers, promotion or discounts.
  3. A Club IR Member may only redeem each Event and/or Experience once per annum.
  4. Photographs and videos may be taken during Rewards, Events and Experiences for the purpose of sharing on Club IR’s social media and/or for marketing purposes. By attending or participating in Rewards, Events and/or Experiences, you consent to your image being used by Club IR for marketing purposes.
  5. Spend may take up to 72 hours to be credited to your Club IR Membership after a visit to a Participating Restaurant.
  6. Spend can be earned when the bill has been paid in part or full by using a gift card.
  7. The Spend from any given bill may only be collected by a single Club IR Membership and may not be given to more than one Club IR Membership, nor may the total be split and shared.
  8. Spend is calculated at the time of visit to a Participating Restaurant by a Club IR Member presenting their Club IR App. Except for special circumstances IR reserves the right to refuse to add Spend retrospectively.
  9. The Club balance will expire if a Club IR Membership has not been used in any 24 month period.
  10. A Club IR Member may only redeem each Event and/or Experience once per annum.
  11. Rewards, Events and Experiences have no cash value and cannot be exchanged for any other product or cash. We reserve the right to withdraw any Rewards, Events and Experiences at any time or to substitute Rewards, Events and Experiences if the need arises.
  12. Club IR Members are responsible for any expenses and arrangements not specifically included in a Reward, Event or Experience, including any necessary travel arrangements, accommodation, facilities at the attraction, spending money, telephone calls, personal items, merchandise and souvenirs, incidental costs, all meals or refreshments, or taxes or expenses which may be incurred in connection with the Reward, Event or Experience.
  13. Failure to attend a Reward, Event or Experience which you have booked, or in which you have agreed to participate or attend, may result in you being excluded from attending or participating in any future Rewards, Events or Experiences.
  14. Events, Experiences and/or competitions hosted by IR may be subject to further terms and conditions not listed here. These terms and conditions will always be communicated alongside any Event, Experience or competition information.
  15. Club IR encourages responsible alcohol consumption and reserves the right to refuse service to any person whom we believe to be inebriated, aged under 18, or for any other reason in our sole discretion.

Liability

  1. This section applies to all Rewards, Events and Experiences.
  2. IR will not be responsible for any communication failure arising from events outside of our control which results in you being unable to check your Spend or redeem a Reward, Event or Experience.
  3. IR are responsible for any foreseeable loss or damage caused by us. If we fail to comply with our obligations to you under these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time we entered into a contract on the basis of these Terms.
  4. IR are not liable for business losses. You agree not to use the Club IR App or any features on the Club IR App, for any commercial, business or re-sale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity and any other like loss (in each case, whether direct or indirect).
  5. IR shall not be liable for any unauthorised use of any Club IR App or Club IR Membership.
  6. Club IR Members shall notify IR of any change of address or other personal details. IR will not be responsible for any loss of Rewards, Events, Experiences or Spend resulting from the failure of a Club IR Member to notify IR of such changes.
  7. We are not liable for matters outside of our control. Except to the extent that liability cannot be excluded or limited as a matter of law, we accept no responsibility or liability for (a) accounts which are created using incorrect or inaccurate information; (b) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications, line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers used in any aspect of the operation of the Club IR App; (c) inaccessibility or unavailability of any network or wireless service, the Internet and/or any website; (d) any injury or damage to any person’s computer(s) or mobile device(s) which may be related to or result from any attempt to participate in the Club IR App or to download any materials in connection with the Club IR App; (e) any unauthorised access to or use of any Club IR Membership resulting from the loss of your mobile device; or (f) any other matter outside of its reasonable control.
  8. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. We therefore do not in any way exclude or limit our liability under or in connection with any contract with you based on these Terms for:
    (a) death or personal injury caused by our negligence;
    (b) fraud or fraudulent misrepresentation;
    (c) any matter for which it would be illegal for us to exclude or attempt to exclude our liability.
  9. The Club IR Scheme and these Terms including any non-contractual disputes or claims arising out of them) are subject to English law. Any disputes must be referred to the English courts (save that consumers in Scotland and Northern Ireland may additionally bring an action in their home courts).
  10. If a court finds part of these Terms illegal, the rest will continue in force. Each of the sections of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining sections will remain in full force and effect.
  11. Waiver. If you breach these Terms and we choose to ignore your breach, or if we delay in taking steps against you, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach the Terms again.
  12. Reliance on these Terms. We intend to rely on these written Terms and any document expressly referred to in them. We and you will be legally bound by these Terms
